Americans With Disabilities Act Seminar

Are you informed regarding the recent changes to the Family and Medical Leave Act and the Americans With Disabilities Act regulations?  For the first time since 1993, the Department of Labor has made significant revisions to the FMLA, and an amendment to the ADA was passed in September of 2008.   Adam Forman of Littler Mendelson P.C. will be discussing the extent of these updates, including: 

Some highlights of the FMLA regulation changes, effective 1/16/09:

• New leave entitlements to employees in order to care for family members who are either injured during military service or called to active military duty
• The FMLA medical certification forms have been updated, and now there are separate forms for employees and their family members
• Many definitions have been updated, posting requirements have changed, and notification periods have changed

Americans With Disabilities Act Amendments Act (ADAAA), effective 1/1/09:

§         The definition of “disability” has been expanded

§         Employers no longer have to provide a reasonable accommodation to employees who are only “regarded” as having a disability

§         “Major life activities” have been defined more clearly and broadly
